STATISTICS (TRADE STATISTICS) (SHANNON FREE AIRPORT) ORDER 2004.

I, TOM KITT, Minister of State at the Department of the Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993), and the Statistics (Delegation of Ministerial Functions) Order 2004 ( S.I. No. 664 of 2004 ), hereby order as follows:

1. (1) This Order may be cited as the Statistics (Trade Statistics) (Shannon Free Airport) Order 2004.

(2) This Order shall come into operation of the 1st day of November 2004.

2. (1) In this Order “Shannon Free Airport” means the Customs-free airport for the purposes of the Customs-free Airport Act 1947 (No. 5 of 1947).

(2) In this Order a reference to an Article or Schedule is a reference to an Article of or the Schedule to this Order.

3. This Order applies to all persons and undertakings which are, at any time during a period in which a survey referred to in Article 4 is undertaken, engaged in all or any of the transactions specified in Part 1 of the Schedule.

4. Information, the general nature of which is specified in the Schedule, is prescribed as information required to be provided for the purposes of surveys undertaken by the Central Statistics Office of persons or undertakings to whom this Order applies, which surveys are to be undertaken in each and every month from November 2004 to October 2009.

5. A person or undertaking to which this Order applies is prescribed as a person or undertaking required to provide the Central Statistics Office with information the general nature of which is specified in Part 2 of the Schedule.

6. A person or undertaking required by virtue of this Order to provide information to the Central Statistics Office shall provide, when requested to do so by that Office, such information by the completion and return of forms prepared by the Director General of the Central Statistics Office in accordance with Section 23 of the Statistics Act 1993 ( No. 21 of 1993 ).

7. A person or undertaking required by this Order to furnish information shall be deemed to comply with that obligation where, with the consent of the Director General of the Central Statistics Office, the information is furnished by electronic means, but only if the Director General approves the format or manner in which the information is provided.

SCHEDULE

Part 1

Importing and exporting goods into and out of Shannon Free Airport from and to countries and territories outside the State (whether directly or in transit through another part of the State).

Part 2

1. Information identifying the person or undertaking engaged in the transaction specified in Part 1 of this Schedule.

2. Information as respects the value of goods (which value is expressed in Euro or other identified currency) imported from and exported to countries or territories or categories of such countries and territories as may be specified in a form prepared by the Director General of the Central Statistics Office in accordance with section 23 of the Statistics Act 1993 .

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The purpose of this instrument is to require that external trade statistics in respect of Shannon Customs-free Airport be furnished each month to the Central Statistics Office covering all undertakings in the Airport in respect of which the prescribed forms have been issued.
