I, IVOR CALLELY, Minister of State at the Department of Transport, in exercise of the powers conferred on me by sections 5 and 11 of the Road Traffic Act 1961 (No. 24 of 1961), the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 )) and the Transport (Delegation of Ministerial Functions) Order 2004 ( S.I. No. 840 of 2004 ), hereby make the following regulations: 1. (1) These Regulations may be cited as the Road Traffic (Construction and Use of Vehicles) (Amendment) (No. 2) Regulations 2004. |

(2) The Road Traffic (Construction and Use of Vehicles) Regulations 2003, the Road Traffic (Construction and Use of Vehicles) Regulations 2004, and these Regulations may be cited together as the Road Traffic (Construction and Use of Vehicles) Regulations 2003 to 2004. 2. The Road Traffic (Construction and Use of Vehicles) Regulations 2003 ( S.I. No. 5 of 2003 ) are amended in Regulation 60 by substituting for paragraph (1) the following-- |

“(1) Notwithstanding any Regulations (including these Regulations) made under Part II of the Road Traffic Act 1961 , the Minister for Transport may issue to any person a special permit authorising the use in a public place of a particular vehicle or a particular combination of vehicles.”. |

These Regulations amend the provisions whereby the Minister may issue a permit for a vehicle to allow its use notwithstanding its non-compliance with Regulations made under Part II of the Road Traffic Act 1961 . |
