CIVIL LIABILITY AND COURTS ACT 2004 (BODIES PRESCRIBED UNDER SECTION 15) ORDER 2005.

I, MICHAEL McDOWELL, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 15 of the Civil Liability and Courts Act 2004 ( No. 31 of 2004 ), hereby order as follows:

1. This Order may be cited as the Civil Liability and Courts Act 2004 (Bodies Prescribed under Section 15) Order 2005.

2. Each of the bodies specified in the Schedule to this Order is prescribed for the purposes of section 15(4)(b)(ii)(II) of the Civil Liability and Courts Act 2004 (No. 31 of 2004).

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order relates to the nomination of chairpersons of mediation conferences in personal injuries actions, in the event that the parties do not agree on the chairperson. In such cases, the chairperson shall be appointed by the Court and shall be either a practising barrister or practising solicitor of not less than 5 years standing or a person nominated by one of the bodies prescribed in this Order. This Order prescribes six bodies which can nominate chairpersons.
