CIVIL LIABILITY AND COURTS ACT 2004 (MATTERS PRESCRIBED UNDER SECTION 40) ORDER 2005

Civil Liability and Courts Act 2004 (Matters prescribed under section 40) Order 2005

I, Michael McDowell, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by subsections (6) and (7) of section 40 of the Civil Liability and Courts Act 2004 ( No. 31 of 2004 ), hereby order as follows:

1.         This Order may be cited as the Civil Liability and Courts Act 2004 (Matters Prescribed under Section 40) Order 2005.

2.         The following matters are prescribed for the purposes of subsections (6)(b) and (7)(b) of section 40 of the Civil Liability and Courts Act 2004 ( No. 31 of 2004 ):

(a) a complaint of misconduct against a barrister;

(b) an appeal against such a complaint.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order prescribes two matters to which section 40(6)(b) and section 40(7)(b) of the Civil Liability and Courts Act 2004 will apply. The two matters concerned are the hearing of a complaint of misconduct against a barrister or an appeal against such a complaint.
