In exercise of the powers conferred on the Secretary of State by sections 19 and 42(6) and (7) of the Teaching and Higher Education Act 1998[1] the Secretary of State for Education and Employment hereby makes the following Regulations:
1.
These Regulations may be cited as the Education (Induction Arrangements for School Teachers) (Amendment) (England) Regulations 2001 and shall come into force on 15th February 2001.
2.
The Education (Induction Arrangements for School Teachers) (England) Regulations 1999[2] shall be amended by the insertion at the end of Schedule 1 of the following paragraphs -
"
14.
A person who on or before 7th May 1999 -
(a) was employed as a teacher at a relevant school in England or Wales; and
(b) either -
(i) had successfully completed a course of initial training for teachers in schools at an educational institution in Scotland, or
(ii) was registered as a teacher of primary or secondary education with the General Teaching Council for Scotland.
15.
A person who on or before 7th May 1999 -
(a) was employed as a teacher at a relevant school in England or Wales; and
(b) either -
(i) had successfully completed a course of initial training for teachers in schools at an educational institution in Northern Ireland, or
(ii) had been awarded confirmation of recognition as a teacher in schools in Northern Ireland by the Northern Ireland Department of Education, that confirmation not having been withdrawn at any time subsequent to the award.
16.
A person who is a qualified teacher by virtue of paragraph 10 of Schedule 3 to the Education (Teachers' Qualifications and Health Standards) (England) Regulations 1999[3].".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend Schedule 1 to the Education (Induction Arrangements for School Teachers) (England) Regulations 1999 (S.I. 1999/1065) to add to the list of cases in which teachers are exempt from the requirement to serve an induction period. The new exemptions are for the following groups of teachers.
(a) Teachers who would have been eligible to obtain qualified teacher status on or before 7th May 1999 on the basis of qualifications obtained in Scotland.
(b) Teachers who would have been eligible to obtain qualified teacher status on or before 7th May 1999 on the basis of qualifications obtained in Northern Ireland.
(c) Teachers who obtain qualified teacher status under paragraph 10 of Schedule 3 to the Education (Teachers' Qualifications and Health Standards) (England) Regulations 1999 (S.I. 1999/2166 as amended by S.I. 2000/2704). This route to obtaining qualified teacher status is open to teachers employed in independent schools who are assessed at meeting the standards for qualified teacher status and who possess specified degrees or other specified qualifications in some cases awarded before 1st January 1974 and in others before 1st September 1989.
