POLICE, ENGLAND AND WALES

The Police and Criminal Evidence Act 1984 (Codes of Practice) (Modifications to Codes C and D) (Certain Police Areas) (Amendment) Order 2004

  Laid before Parliament 16th January 2004 
  Coming into force 1st April 2004 

In exercise of the powers conferred on him by section 67(7A) of the Police and Criminal Evidence Act 1984[1], the Secretary of State hereby makes the following Order:

     1. This Order may be cited as the Police and Criminal Evidence Act 1984 (Codes of Practice) (Modifications to Codes C and D) (Certain Police Areas) (Amendment) Order 2004 and shall come into force on 1st April 2004.

    
2. Article 3 of the Police and Criminal Evidence Act 1984 (Codes of Practice) (Modifications to Codes C and D) (Certain Police Areas) Order 2003[2], is amended as follows:

EXPLANATORY NOTE

(This note is not part of the Order)


Section 63B of the Police and Criminal Evidence Act 1984 gives police officers a power to undertake tests for the presence of specified Class A drugs in relation to certain persons in police detention. The power is in operation in a limited number of police areas and modifications to Codes C and D have been made in those police areas.

This Order extends, from 1st April 2004, the modified versions of Codes C and D to apply to the police areas of Cambridgeshire, Leicestershire, Northumbria and the West Midlands.
