SOCIAL SECURITY

The Social Security (Hospital In-Patients) Amendment Regulations 2004

  Made 19th January 2004 
  Laid before Parliament 26th January 2004 
  Coming into force in accordance with regulation 1

The Secretary of State for Work and Pensions, in exercise of the powers conferred upon him by sections 73(1)(b) and 189(1) and (4) of the Social Security Administration Act 1992[1] and of all other powers enabling him in that behalf, and after agreement by the Social Security Advisory Committee that proposals to make these Regulations should not be referred to it[2], hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Social Security (Hospital In-Patients) Amendment Regulations 2004 and shall come into force for the purposes of - 

Amendment of the Social Security (Hospital In-Patients) Regulations 1975
     2.  - (1) The Social Security (Hospital In-Patients) Regulations 1975[4] shall be amended in accordance with the following paragraphs of this regulation.

    (2) In regulation 2(1)[5] (interpretation) - 

    (3) In regulation 6(1)[6] (adjustment of personal benefit after 52 weeks in hospital where person has a dependant) -

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Social Security (Hospital In-Patients) Regulations 1975.

These Regulations amend the amount of benefit payable to a beneficiary's dependant after the beneficiary has received 52 weeks of free in-patient treatment in a hospital and then has his benefit adjusted so that the first 20% only of the basic pension is payable. They provide that the next 38%, instead of 40%, of the basic pension is not payable and any excess over 58%, instead of 60%, of the basic pension is payable to the dependant.

A regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
