The Secretary of State for Environment, Food and Rural Affairs, in exercise of the powers conferred upon her by section 15 of the Social Security Act 1990[1] and with the consent of the Treasury, makes the following Regulations:
Title and commencement
1.
These Regulations may be cited as the Home Energy Efficiency Scheme (England) (Amendment) Regulations 2004 and come into force on 15th October 2004.
Amendment of the Home Energy Efficiency Scheme (England) Regulations 2000
2.
In regulation 4(1)(e) of the Home Energy Efficiency Scheme (England) Regulations 2000[2] for the figure "£14,200" substitute "£14,600".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Home Energy Efficiency Scheme (England) Regulations 2000 (S.I. 2000/1280, as amended) in regulation 4(1)(e) so as to raise the threshold of the relevant income for the purposes of the eligibility to apply for a grant for the improvement of energy efficiency in their dwellings of persons in receipt of child tax credit or working tax credit which includes a disability element from £14,200 to £14,600.

As regards Wales, those functions are exercisable by the National Assembly for Wales concurrently with the Secretary of State; see the reference to the Social Security Act 1990 in Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).back
